Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by SecureMessage ("we", "us", or "our") at www.securemessage.cc, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

SecureMessage provides secure email infrastructure, messaging APIs, web form hosting, and instant messaging services. Services are provided on a subscription basis with free and paid tiers as described on our Pricing page.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use our services only for lawful purposes. The following activities are strictly prohibited:

  • Sending unsolicited bulk email (spam)
  • Distributing malware, viruses, or other harmful code
  • Phishing, spoofing, or impersonating others
  • Infringing on copyrights, trademarks, or other intellectual property rights
  • Transmitting content that is illegal, threatening, abusive, or harmful to minors
  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Using the Service to violate any applicable law or regulation

Violation of this acceptable use policy may result in immediate suspension or termination of your account without notice.

5. Zero Tolerance Spam Policy

SecureMessage maintains a zero tolerance policy against unsolicited email, bulk emailing, and spam. Any account found sending spam will be terminated immediately. Sites advertised via spam may not use our services. We reserve the right to charge a cleanup fee at our discretion.

6. Payment and Billing

Paid services are billed on a recurring basis (monthly or annually). You agree to provide valid payment information and authorize recurring charges. Prices are subject to change with 30 days notice. Cancellations must be submitted in writing via email to sales@securemessage.cc.

7. Service Level

We strive to maintain 99.9% uptime for all paid services. Free tier services are provided on a best-effort basis without uptime guarantees.

8. Data and Backups

You are responsible for maintaining backups of your data. While we implement redundancy measures, SecureMessage is not responsible for data loss. You agree to take full responsibility for data transferred to and stored on our servers.

9. Intellectual Property

All content, trademarks, and intellectual property related to SecureMessage are owned by The Daniel Morante Company, Inc. You may not use our branding without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by law, SecureMessage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SecureMessage, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These terms shall be governed by the laws of the State of Florida, United States of America, without regard to conflict of law principles.

14. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.
